The existence of free elections is an essential condition to the democratic qualification of a political system. However, elections get its legitimacy in an argumentative public process that precedes. The author provides a complete study about the most outstanding problems of electoral campaigns and their juridical regularisation in Spain (political parties, the role of the mass media, financial support).
